US Judge Orders Freedom of Abrego Garcia from Immigration Detention
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment lacks lawful basis.
"Since his return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.
The case originates in a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an error. After his repatriation to the United States to face alien smuggling charges, he was held in federal custody.
In her order, the judge noted that the government does not have a current removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."

The court challenge center on conflicting claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this claim.
